Ours is a small firm with mostly small clients. Battling, usually, against the big guys represented by the big firms. John Drayton has been a courtroom lawyer for over 30 years. Blake Tancock enters the courtroom with youthful enthusiasm.
Our philosophy is that good trial counsel can take on almost any case. We believe in making a thoughtful, early assessment of a case. Is it a winner? What is a likely court award at the end of the day? If we don’t make that assessment at the beginning, and constantly re-assess the case as more evidence comes to light, we are not doing our jobs correctly. Similarly, we need to devote an appropriate amount of legal resources (read “client’s money”) to the case. A $60,000 case requires a different approach than a $600,000 case.
A case is advanced with the gathering of evidence. In many cases that means engaging an expert witness. A case must be properly pleaded. Often there are skirmishes in court called “pre-trial procedures”. Usually there are examinations for discovery. The ultimate end is a trial, although the vast majority of cases settle before then.
We find that our best source of referrals is other lawyers. Lawyers who can’t take on a case due to conflict of interest; lawyers who prefer not to go to court; law firms who find a case to be too complex or not “big enough”. Those lawyers refer to us because they know that we can get the job done.
Our practice is far from routine. We love the challenges and the variety. Our files have involved things like:
